Motorcycle Rental Terms and Conditions

Version 20 October 2026

1. Rental company and scope

1.1. These terms govern motorcycle rental by KD18 holdings s.r.o., company identification number (IČO) 17745837, VAT identification number (DIČ) CZ17745837, registered office Růžová 972/1, Nové Město, 110 00 Praha 1, Czech Republic, registered in the Commercial Register maintained by the Municipal Court in Prague, section C, file 375547 (the “Rental Company”), trading as Tripola Motorrad at https://tripolamotorrad.com.

1.2. Contact for bookings, notices and complaints: info@tripolamotorrad.com; +420 776 025 443. Office: Antala Staška 1859/34, 140 00 Praha 4-Krč, Czech Republic. The collection and return locations are specified in each booking and need not be the registered office.

1.3. The renter (the “Renter”) may be an individual or a legal entity. A consumer is an individual acting outside their trade, business or profession. Only individuals expressly authorised under the agreement may ride the motorcycle.

1.4. These terms cover motorcycle rental without a rider, agreed equipment and related delivery. Separate accommodation, tours, digital products and package travel require their own terms. Mandatory package travel rules apply whenever the actual combination of services constitutes a package, irrespective of its description.

2. Booking and formation of the agreement

2.1. Website listings invite customers to submit a booking request or an order; they do not themselves constitute a binding offer. A request for availability does not oblige the customer to pay. A binding order is clearly identified as such before submission.

2.2. Before a binding order, the Rental Company provides the motorcycle model or expressly agreed category, rental dates and times, collection and return locations, rider requirements, total price including taxes and compulsory charges, included services, payment schedule, security deposit, damage and theft excesses, material exclusions, authorised countries, mileage allowance and excess mileage rate, selected extras and cancellation terms. The rental is for a fixed period and does not renew automatically.

2.3. The Renter can review and correct entries before submitting the order and expressly accepts these terms. The final button is labelled “Order with obligation to pay” or an equally unambiguous expression. Paid extras require a separate, active choice. Immediately before ordering, the essential service details, total price and duration are clearly displayed.

2.4. The Renter's binding order is an offer to contract. The agreement is concluded when the Rental Company's express acceptance reaches the Renter by email. An automatic receipt acknowledgement or payment alone is not acceptance. Acceptance is sent within the period disclosed before ordering, no later than two working days after the order and in every case before collection. Otherwise the order lapses. Changes to the order require the Renter's express agreement. Any payment for an unaccepted order is refunded in full without undue delay, at the latest within 14 calendar days after the order lapses or is rejected.

2.5. The Rental Company acknowledges receipt of an online order without undue delay and sends the booking confirmation, these terms and the agreed individual conditions by email in a form that can be saved, before performance begins. The handover record documents the vehicle's condition; it does not introduce new rental obligations.

2.6. Expressly agreed individual conditions prevail over these terms, subject to mandatory law. An increase in price or excess, a new charge or another change requires agreement; later website amendments do not alter an existing booking.

2.7. Agreements may be concluded in Czech, German, English or Spanish, as selected and confirmed during booking. The Rental Company keeps the agreement and supplies a copy on request; access does not depend on maintaining an online account. The customer pays only their provider's normal communication charges. Any other booking channel must satisfy the applicable statutory requirements, including those for telephone contracts.

3. Rider eligibility

3.1. The published standard requirements are a minimum age of 25 and possession of a valid, unrestricted category A licence for at least three years. These are commercial eligibility requirements, not a statement of the statutory licensing age. Model-specific requirements must be disclosed before ordering, objectively justified and proportionate to safety or valid insurance requirements, and applied without unlawful discrimination.

3.2. At collection, the authorised main rider presents an original valid passport or identity card, an original driving licence valid for the motorcycle and countries concerned, and a credit card in their name for the deposit. An international driving permit must accompany the national licence where legally required. Alternative deposit arrangements must be agreed in advance. Identity documents are checked only to the extent necessary and lawful.

3.3. Additional riders require prior document checks and express inclusion in the agreement. The Renter supplies accurate information and promptly reports changes affecting the legal entitlement to ride.

3.4. The Rental Company may withhold handover for missing required documents, unpaid amounts or deposit, failure to meet lawful disclosed requirements, or objective indications of unsafe riding, including intoxication. It records the reason. Any financial claim must be proportionate and supported by a contractual and legal basis; withholding handover does not automatically entitle the company to retain all payments. An unjustified refusal by the Rental Company is not a customer cancellation.

4. Price and payment

4.1. The booking specifies the fixed price, currency, payment methods, advance payment and balance due dates. The agreed payment schedule takes precedence over the statutory default time for paying rent. The basic price includes rental, compulsory motor liability insurance, agreed damage and theft protection with an excess, and applicable taxes. Equipment, delivery, one-way return and additional protection are charged only if expressly selected and priced.

4.2. Fuel, parking, road charges and fines are excluded unless expressly included. Excess mileage is charged only against an allowance and rate disclosed and agreed before ordering. No undisclosed compulsory charge is added after booking.

4.3. The security deposit is separate from the rental price. Currency conversion by the customer's bank follows that bank's terms. The Rental Company does not impose prohibited payment surcharges and discloses any lawful surcharge before ordering. It provides the legally required payment or service receipt.

4.4. For late payment, the Rental Company gives notice and a reasonable additional period where the law requires it. Termination and deductions require a lawful basis and an itemised calculation. A subsequent website price increase does not change the agreed price.

5. Cancellation and ending the rental

5.1. Contractual cancellation notices may be emailed to info@tripolamotorrad.com, identifying the Renter and booking. For the cancellation scale, the time of receipt counts, not the time a member of staff replies. Time before collection is measured in complete 24-hour periods. Statutory notices may also be given by any legally permitted method; these terms do not impose a stricter form.

5.2. For voluntary contractual cancellation, the following maximum charges apply to the agreed motorcycle rental price, subject to the reductions in clause 5.3:

Time before collectionMaximum cancellation chargeMinimum refund if rental paid in full
At least 30 days0%100%
At least 15 but less than 30 days50%50%
Less than 15 days100%0%

5.3. A charge must be reasonable. Saved expenses and income from re-renting the same motorcycle for the same period are deducted to prevent double recovery. The Renter may demonstrate a smaller loss or no loss. Unprovided extras are refunded, except for reasonable, non-recoverable costs specifically disclosed and agreed beforehand. Advances are credited against the lawful charge; any additional amount requires an itemised basis. The security deposit is not part of the cancellation price. This scale does not apply to a lawful termination or withdrawal for which such a charge is not permitted.

5.4. Changes to dates, motorcycle, rider or return location require agreement, subject to availability, and disclosure of the revised price before acceptance. Failure to collect without notice is treated as cancellation less than 15 days before collection, subject to clause 5.3. If delayed, the Renter should contact the Rental Company to arrange collection.

5.5. The Renter may also terminate the rental on ten days' notice, without a termination penalty. The notice period starts on the day after receipt. Rent is payable only for the agreed rental period falling before termination takes effect; any later prepaid rental is refunded. An earlier agreed expiry remains unchanged. Simply returning the motorcycle early does not itself shorten the agreement; the Renter may give notice at the same time. Rights to end the agreement immediately or obtain a price reduction on statutory grounds remain unaffected.

5.6. For rental of a means of transport on a specific date or for a specific period, section 1837(j) of Czech Act No. 89/2012 Coll., the Civil Code, excludes the ordinary 14-day right to withdraw from a distance contract without giving reasons. This does not remove the cancellation rights in these terms, statutory termination rights, remedies for defects or other mandatory consumer rights. The exception does not automatically cover separately purchased digital content or other services.

5.7. If the agreed motorcycle cannot be supplied, a replacement requires the Renter's consent. Without agreement, payments for unprovided services are refunded without a cancellation charge. Refunds under this section are made within 14 calendar days after the right to repayment arises, by the original payment method unless another method is agreed at no extra cost to the Renter. Any statutory right to damages remains unaffected.

6. Security deposit

6.1. The amount for the chosen motorcycle and the method of providing the deposit are disclosed before ordering. Unless otherwise agreed, a hold is placed on the authorised main rider's credit card before handover.

6.2. The deposit secures substantiated claims, including unpaid rent, damage, missing items and agreed additional charges. It is not a payment automatically forfeited on breach. The deposit and the insurance excess are different amounts; the deposit alone neither fixes nor limits liability.

6.3. The Rental Company initiates release of the hold or refund of a cash deposit within three working days after return. Only the amount reasonably required for a specifically identified, substantiated claim may remain secured. The bank controls the time until a card hold actually disappears.

6.4. The Rental Company provides the grounds, evidence and calculation for any proposed deduction and allows the Renter to comment. An estimate is identified as such, followed without undue delay by a final account. The unneeded balance is released promptly. Neither an indefinite unexplained hold nor a debit unrelated to a justified claim is permitted. The Renter retains all rights to challenge a claim or payment.

7. Collection and return

7.1. The motorcycle is supplied roadworthy, fit for the agreed use, with necessary documents, agreed equipment and a full fuel tank. Both parties receive a handover record containing identification, mileage, fuel, equipment and existing damage. The Renter may take photographs.

7.2. The Renter may reject an unroadworthy motorcycle. If unfitness becomes apparent later, the Renter may return it and seek repair, replacement or cancellation of the agreement as provided by section 2322 of the Czech Civil Code. Signing a record does not waive remedies for hidden defects.

7.3. Return is at the agreed place and time with the full tank, keys, documents and equipment. An extension requires express confirmation; merely reporting a delay does not extend the rental. Unattended or out-of-hours return requires an agreed procedure stating where to leave the vehicle and keys and how return is recorded.

7.4. On return, condition, mileage, fuel and equipment are recorded. Normal wear is not chargeable. If inspected without the Renter, the results and supporting evidence are supplied without undue delay; absence does not amount to acceptance of a damage claim.

7.5. The following charges must be disclosed before ordering. Service charges are limited to reasonable, evidenced costs within the stated maximum, including applicable taxes:

EventCharge or maximum
Missing fuelActual missing fuel cost plus a refuelling service charge of up to EUR 30
Excessive dirt beyond normal road useAdditional cleaning costs of up to EUR 50
Return more than 60 minutes lateFor time beyond the first 60 minutes, hourly rent at 1/24 of the agreed daily rate, calculated to the minute
Actual processing of an official traffic fineAdministrative costs of up to EUR 50 per separate case

7.6. Late-return rent never exceeds the corresponding pro rata daily rate; no automatic extra day's penalty applies. One case or expense is not charged twice. No charge is made for a delay or extra work caused by the Rental Company's breach. Any additional damages require a separate legal basis and proof, taking payments already received into account.

8. Use of the motorcycle

8.1. Riders comply with traffic law, the manufacturer's instructions and the agreed use. They monitor obvious faults, tyre pressure and fluid levels as instructed, use the specified fuel and stop riding if a fault makes continued use unsafe. Riders and passengers wear legally required protective equipment.

8.2. The motorcycle must be secured with the supplied locking devices. Keys and documents must not be left accessible to unauthorised persons. These duties do not create unconditional liability for every loss.

8.3. Riding while impaired by alcohol, drugs or medication, unauthorised riders, subletting, racing, competitions, track use, unlawful use and exceeding permitted loads are prohibited.

8.4. Off-road and hard-enduro riding are prohibited. Publicly accessible gravel roads are permitted only where expressly authorised for the chosen model and compatible with the agreed protection.

8.5. Authorised countries are listed in the booking with reference to insurance and roadside assistance. Travel outside that territory, including outside the EU and Schengen Area, requires prior written approval. General advertising about cross-border trips does not replace the individual territorial agreement.

9. Insurance and liability

9.1. Before ordering, the Renter receives the scope of compulsory liability insurance and any agreed damage or theft protection, territory, excesses, material exclusions and incident procedures. Insurance coverage and any contractual limitation of the Renter's liability are identified separately. A contractual damage waiver is not described as a separate insurance policy unless that is actually the product provided.

9.2. Under the basic option, the agreed liability limit for covered motorcycle damage, including collision or fire, is EUR 3,000 per event and for covered theft EUR 5,000 per event, unless a different option is expressly agreed before ordering. The limits are confirmed for the chosen motorcycle. The Renter never pays more than the substantiated loss for which they are liable; the excess is not a fixed penalty for minor damage.

9.3. Liability beyond an agreed limit requires a lawful, clearly disclosed basis and proof of the circumstances establishing that liability, including any required causal connection. An insurer's refusal alone does not establish unlimited liability to the Rental Company. Statutory rules governing intentional conduct or gross negligence remain unaffected.

9.4. Any exclusions for tyres, rims, mirrors, keys, documents, personal belongings, unauthorised riders or impaired riding must be specifically identified before ordering. An exclusion does not itself prove liability. Personal medical or travel insurance is not included unless expressly stated.

9.5. Claims reflect actual reasonable repair costs or loss, pre-existing condition, ordinary wear, insurance proceeds and payments by responsible third parties. There is no double recovery. Existing damage is not charged to the Renter. Additional losses require proof and a legal basis.

9.6. The Rental Company remains responsible for its obligations. Nothing excludes liability for harm to natural rights, harm caused intentionally or by gross negligence, or a weaker party's right to compensation where section 2898 of the Czech Civil Code prohibits exclusion or limitation. Mandatory consumer remedies remain intact.

10. Accidents and breakdowns

10.1. The rider secures the scene, seeks emergency assistance where needed and informs the Rental Company without undue delay. Police must be contacted for theft, injury, cases required by local law or where necessary under claims procedures disclosed beforehand.

10.2. Where safe, the rider records the circumstances, damage, participants and witnesses, retains documents and cooperates in the claim. The rider must not leave unlawfully or accept obligations on the Rental Company's behalf; they must provide truthful factual information.

10.3. Repairs and recovery are agreed in advance, except for urgent action to protect people, obey authorities or prevent greater harm. Necessary and reasonable expenses must be documented. Responsibility for costs follows the cause, the agreement and the law. Statutory reimbursement of maintenance costs is preserved; where section 2325(2) applies, the claim must be asserted within three months of incurring the expense.

10.4. For a fault not attributable to the Renter, the Rental Company arranges a remedy or offers replacement within a reasonable time. The Renter may claim remission or reduction of rent for the affected period and, where justified, terminate the agreement and receive a refund. Defects should be reported without undue delay. The Rental Company will not reject an otherwise timely defect claim solely because it was submitted after the agreed rental period ended. Statutory damages rights remain unaffected.

11. Fines and serious breach

11.1. The Renter pays road charges, parking and fines lawfully attributable to them. The Rental Company may disclose necessary rider information to competent authorities as permitted or required by law.

11.2. An official notice received by the Rental Company is supplied to the Renter with information needed for payment or challenge. The administrative charge in clause 7.5 is separate from the fine and is not repeated for multiple letters concerning one case.

11.3. For a serious breach threatening safety, property or lawful use, the Rental Company may require use to stop and seek termination and return on the applicable legal grounds. An opportunity to remedy is given where required. Recovery must be safe and lawful; all payments are not automatically forfeited.

11.4. In exceptional events, both parties give prompt notice and reasonably mitigate loss. Such events do not automatically justify retaining payment for services not provided or excluding mandatory rights. Ordinary changes in weather do not automatically cancel the rental.

12. Complaints and dispute resolution

12.1. Defect claims and complaints may be sent to info@tripolamotorrad.com, made at the registered office, or made at any establishment where acceptance is possible given the services provided. A booking reference, description and requested remedy assist handling but are not mandatory if the agreement can otherwise be identified. The consumer provides reasonable cooperation needed to assess the claim.

12.2. The Rental Company gives written confirmation of the claim date, content, requested remedy and contact details for notification. A consumer defect claim, including remedying the defect and informing the consumer of the outcome, is handled without undue delay and within 30 days unless a longer period is individually agreed. After expiry of that period without resolution, the consumer may withdraw from the agreement or request an appropriate price reduction under section 19(4) of Act No. 634/1992 Coll. A written outcome records the date and manner of resolution, any repair and its duration, or reasons for rejection. The 30-day limit does not justify delaying urgent roadside assistance.

12.3. If direct resolution fails, consumers may apply to Česká obchodní inspekce (Czech Trade Inspection Authority), ADR department, Gorazdova 1969/24, 120 00 Praha 2, Czech Republic; adr@coi.gov.cz; https://coi.gov.cz/informace-o-adr/. The application must be made within one year of first asserting the relevant right against the Rental Company. ADR does not prevent court proceedings.

12.4. Czech law governs the agreement. This choice does not deprive a consumer of mandatory protection under the law that would otherwise apply, including their country of habitual residence where the relevant conflict-of-laws rules so provide. Jurisdiction follows the applicable rules, including consumer jurisdiction rules; there is no exclusive Prague court clause for consumers.

13. Personal data and final provisions

13.1. KD18 holdings s.r.o. processes necessary personal data for booking, contractual performance, legal obligations and protection of legitimate interests on the relevant GDPR bases. The separate Privacy Policy on the website explains recipients, retention, rights and contact arrangements. Acceptance of these terms is not consent to advertising.

13.2. The agreed booking language governs the contractual communication. Czech, German, English and Spanish versions are intended to have the same meaning; no automatic priority of another language reduces consumer rights. Ambiguous consumer terms are interpreted in the consumer's favour as required by Czech law. Information that must legally be provided in Czech remains available in Czech.

13.3. The version supplied before the order and accepted for the booking applies throughout that agreement. Later versions apply only to new agreements unless a lawful amendment is expressly agreed. An ineffective provision is replaced by the applicable law, without converting an unfair term into the most extensive restriction otherwise possible.

13.4. Notices are sent to the agreed contacts; each party reports changes. Electronic communications may serve as evidence under applicable law. These terms do not restrict legally available methods of giving notice or asserting rights.
