1. Introductory Provisions

1.1. These General Terms and Conditions (hereinafter referred to as “GTC”) regulate the mutual rights and obligations between the Lessor (Tripola Motorrad, operated by: KD18 holdings s.r.o., Business ID (IČ): 177 45 837, VAT ID (DIČ): CZ17745837, registered office at: Růžová 972/1, Nové Město, 110 00 Praha 1 (hereinafter referred to as the “Lessor“) and the natural or legal person renting the vehicle (hereinafter referred to as the “Lessee“) .

1.2. By signing the Rental Agreement or confirming a binding reservation online, the Lessee confirms that they have read these GTC and agree to be bound by them.


2. Requirements for the Lessee

2.1. The Lessee (rider) must meet the following requirements:

  • Minimum age of 25 years.
  • Possession of a valid motorcycle driving license (Category A), held for at least 3 years.
  • Presentation of a valid Passport or ID card and the Driving License upon pick-up.

2.2. The Lessor reserves the right to refuse rental if the Lessee fails to present these documents or if the Lessor has reasonable doubts about the Lessee’s ability to operate the motorcycle safely.


3. Reservation and Payment Terms

3.1. A reservation is considered binding once confirmed by the Lessor and the payment is processed.

3.2. Rental Fees: The rental price includes vehicle usage, statutory insurance (POV), accident insurance (havarijní pojištění) with a deductible, and taxes. It does not include fuel or traffic fines.

3.3. Cancellation Policy:
If the Lessee cancels the reservation, the following fees apply:

  • 30 days or more before the pick-up date: 100% refund (Free cancellation).
  • 15 to 29 days before the pick-up date: 50% refund.
  • Less than 15 days before the pick-up date: No refund (100% cancellation fee).

3.4. If the Lessee returns the motorcycle earlier than agreed, the Lessor is not obliged to refund the unused portion of the rental fee.


4. Security Deposit

4.1. Before handing over the motorcycle, the Lessee must provide a refundable Security Deposit.

4.2. The deposit amount is specified in the Rental Agreement (varying by motorcycle model).

4.3. The deposit is blocked (pre-authorized) on the Lessee’s credit card.

4.4. The deposit serves to cover potential damages, insurance deductibles, missing fuel, cleaning fees, or traffic fines.

4.5. The deposit (or the hold on the card) will be released within 3 business days after the vehicle is returned without damage.


5. Rights and Obligations of the Lessee

5.1. The Lessee is obliged to:

  • Use the motorcycle solely for its intended purpose and in accordance with road traffic regulations.
  • Protect the motorcycle from theft and damage (using steering locks, alarm, etc.).
  • Check the oil level, tire pressure, and general condition of the bike regularly during long trips.
  • Use only the fuel type specified by the manufacturer (usually E5/Premium Unleaded).

5.2. Prohibited Uses:
The Lessee must NOT:

  • Use the motorcycle for racing, competitions, or off-road riding (gravel roads legally open to traffic are permitted; cross-country/hard enduro is prohibited).
  • Sublease the motorcycle to third parties.
  • Ride under the influence of alcohol, drugs, or medication affecting reaction times.
  • Ride in countries outside the European Union (EU) and Schengen Area without prior written consent from the Lessor.

6. Vehicle Handover and Return

6.1. Pick-up: The motorcycle is handed over clean, with a full tank of fuel, and in good technical condition. Any pre-existing scratches or damages are recorded in the Handover Protocol.

6.2. Return: The Lessee must return the motorcycle:

  • At the agreed time and location.
  • With a Full Tank of fuel (“Full-to-Full” policy). Failure to refuel will result in a surcharge of €30 plus the cost of fuel.
  • In a reasonably clean condition. Excessive dirt (e.g., heavy mud) may incur a cleaning fee of €50

6.3. Late returns exceeding 60 minutes without prior notice may be charged as an additional rental day.


7. Insurance and Liability

7.1. Third-Party Liability (POV): Included in the rental price. Covers damages caused to others.

7.2. Collision Damage Waiver (CDW): The motorcycle is insured against damage and theft. However, the Lessee is liable for damages up to the amount of the Deductible (Excess) specified in the contract.

7.3. Full Liability: The insurance does NOT cover (and the Lessee is fully liable for):

  • Damages caused by riding under the influence of alcohol or drugs.
  • Damages caused by unauthorized riders.
  • Damages to tires (punctures), rims, and mirrors, unless caused by a traffic accident involving another vehicle.
  • Loss of keys or documents.
  • Theft of personal belongings (helmets, jackets, navigation) left on the bike.

8. Accidents and Technical Failures

8.1. In the event of an accident, theft, or damage, the Lessee must:

  • Immediately inform the Police (if a third party is involved or damages are significant) and obtain a police report.
  • Immediately inform the Lessor via phone/email.

8.2. In case of a technical breakdown not caused by the Lessee, the Lessor will attempt to provide a replacement vehicle or arrange roadside assistance.


9. Traffic Fines

9.1. The Lessee is fully responsible for all traffic violations (speeding, parking, etc.) committed during the rental period.

9.2. If the Lessor receives a fine notification after the rental, the Lessee agrees to pay the fine plus an administrative handling fee of €50.


10. Final Provisions

10.1. Legal relations not regulated by these GTC are governed by the laws of the Czech Republic.

10.2. The place of jurisdiction for any disputes is the court competent for the Lessor’s registered office in Prague.
